These general conditions govern the use of this website and form part of any agreement between REGIOSUS S.L. and its clients and users.

1. Scope

These general conditions form part of any agreement between REGIOSUS S.L., C/ Llorenç Vicens 3, 4º, 07002 Palma, Spain, company registration number B13828900, hereafter the provider, and the users of the provider’s website and services. Legal successors of both parties are equally bound by them.

This website presents the provider’s company and its activities. It is an information site and is not itself a service that can be purchased or subscribed to.

The provider performs its activities exclusively on the basis of these general conditions. Conditions of the user or the client that differ from these are only binding where the provider has accepted them in writing.

2. Use of the website

The content of this website is presented as an invitation to make contact and does not constitute a binding offer. No agreement arises from visiting the site.

The user may consult the website for personal or professional information purposes. Reproduction, distribution, modification or commercial use of its content requires the prior written consent of the provider.

The user refrains from any use that disturbs the functioning of the website, that circumvents its security, or that is unlawful towards the provider or towards third parties.

3. Individual services

The provider offers services which are described and agreed separately from this website. The scope, the duration, the price where a price applies, the method of payment and the manner of termination of such a service are laid down in the conditions belonging to that service, which are made available to the client or user before the agreement is concluded.

Where a provision of the conditions belonging to an individual service differs from these general conditions, the conditions of that service prevail for that service.

4. Conclusion of an agreement

An agreement between the provider and a client comes into being once the client accepts a proposal in writing, or once the client confirms an offer in the manner described in the conditions of the relevant service, or once the provider begins performance at the client’s request.

The party entering into an agreement warrants that it is authorised to do so. A party acting on behalf of one or more others is liable towards the provider as if it were the contracting party itself, without prejudice to the liability of those others.

5. Rights of use

All rights to this website and to the materials, texts, images, designs and software it contains rest with the provider or its licensors. The user acquires no rights other than those expressly granted.

Where an agreement concerns the delivery of materials, the client acquires a non transferable right of use for the agreed purpose and the agreed period, unless otherwise agreed in writing.

6. Availability

The provider makes reasonable efforts to keep this website available and its content accurate and current, and presents its offering in accordance with prevailing technical standards.

The provider gives no guarantee that the website will be accessible without interruption or free of error, nor that it can be displayed correctly on every device or in every browser. Maintenance, technical faults, and circumstances at hosting providers or networks may temporarily limit availability.

7. Liability

The provider is liable for damage arising from intent or negligence on the part of the provider, its employees or those it engages. Liability for indirect damage, including lost profit, lost turnover, lost savings and reputational damage, is excluded.

The provider is not liable for damage arising from the use of information on this website, from decisions taken on the basis of it, or from circumstances beyond its reasonable control, including failures at networks, platforms and suppliers.

The limitations in this article do not apply to damage to life, body or health, nor in any other case where liability cannot be limited under applicable law. Statutory rights of consumers remain unaffected.

8. Third party links

This website may contain links to websites operated by others. The provider has no control over their content and accepts no responsibility for it. Placing a link does not imply endorsement or a relationship between the provider and the operator of that site.

9. Personal data

The provider processes personal data in accordance with applicable data protection law and exclusively for the purposes described in its Privacy Policy, which forms part of these conditions. Data which must be retained for legal reasons is kept only for as long as that obligation requires.

10. Amendment of these conditions

The provider may amend these general conditions. The amended version applies from the moment it is published on this website. Where an amendment materially affects an ongoing agreement, the provider gives reasonable notice, and the other party may terminate that agreement before the amendment takes effect if it does not accept it.

11. Applicable law and final provisions

Spanish law applies to these general conditions and to every agreement to which they relate. The applicability of the Vienna Sales Convention 1980 is expressly excluded.

Disputes are submitted to the competent court of Palma de Mallorca, Spain. A user acting as a consumer retains the protection of the mandatory law of the country in which that user resides and may bring proceedings before the courts of that country.

If a provision of these conditions is void or invalid, the remaining provisions remain in force, and a valid provision approximating the intended effect of the void provision as closely as possible applies in its place.
